Scope: All services, in particular the web app and mobile app of Swoice Internet Service GmbH (referred to in the text as 'swoice').
By registering with swoice, you undertake to comply with the following terms of use in a legally binding manner. If you do not agree to the terms of use, you may not access swoice.
Why terms of use?
With swoice, you decide which content is important and should be found online. To ensure that your swarm-intelligent networking functions smoothly, we need rules that apply to all users.
1. Comply with the rules of the game
1.1 By registering with swoice, you can actively participate and undertake to comply with these terms of use.
1.2 Select content in the network, set your own tags or mark tags so that the content can be found by others.
1.3 The number and timing of tags determines which content is displayed and found first.
1.4 You can hype content that is important to you via a 'Call for Tagging' so that your friends can help decide what will be found even better online in the future.
2. Register your account
2.1 If you want to set or mark new tags for content on the web, log in to swoice. To register for the first time, use your email address or your account on other platforms.
2.2 You can freely choose your username. You must always choose a secure password that you keep secret and you may not share your account with others.
2.3 As a logged-in user, you can use all swoice functions. View all content for which you have already marked tags. Receive new content on tags that you follow and want to be active on.
2.4 You use swoice exclusively via the user interface provided and comply with all specified security and identification measures. The use of bots is prohibited.
2.5 If you are still a minor, you may only use swoice with the consent of your legal guardians, who must check and are responsible for ensuring that you comply with the terms of use. Your legal guardians must have access to your account at all times, but absolutely no one else.
2.6 No one is entitled to access to swoice. swoice reserves the right to delete accounts at any time. The deletion of an account does not have to be justified. If violations of the terms of use become known, access will be deleted immediately and, if necessary, legal action will be taken.
3. Deleting your tags
You can delete your tags on the tags at any time, e.g. if the content of a website has changed over time.
4. Use of your data
4.1 You are the owner of your data transmitted to swoice, in particular your tagged tags. You grant swoice permission to use all your data and in particular to store and publish it anonymously in the global database swoice openverse. The swoice openverse database only contains anonymised data, so that no conclusions can be drawn about you as a person.
4.2 All data in swoice openverse is part of the swarm-intelligent community performance, which is updated daily. Due to the anonymisation, selective deletion of your data stored in swoice openverse is impossible, even if you delete your account in the future.
4. 3 In order for a swarm-intelligent community service to be created and further utilised, you allow swoice to use, publish, reproduce, process, exploit, license, market, make available and also delete all your transmitted data in connection with the marked content on the network without further consent on your part or notification and/or compensation payment to you or third parties, in any way, without restriction in terms of content, for all media, unrestricted in terms of time and location for all countries and oceans of the world and outer space.
4.4 In return, swoice will make the results of the swarm-intelligent joint effort freely accessible and usable for the public on swoice.com.
4.5 The commercial use of the swarm-intelligent joint effort is only permitted with the written authorisation of Swoice.
5. You have a duty of care
5.1 Most online content providers only provide content that complies with the applicable law and common decency in their country. However, it is also possible that content on the internet violates applicable law and may not be distributed. This is where your duty of care is required when setting and tagging tags! Illegal content, including content that does not comply with copyright and trademark law, must never be inserted as a link via swoice or marked with tags. If you set your tags to illegal content or mark existing tags, your access will be blocked immediately and swoice is obliged to involve the law enforcement authorities.
5.2 Illegal content must be reported by you to the provider of the content so that the provider can delete this content and the users of swoice are no longer bothered by it.
5.3 You must immediately report content linked to swoice that shows pornography with adults, sexual abuse of minors, extremism or other content harmful to minors to the Complaints Office for Voluntary Self-Regulation of Multimedia Service Providers (FSM):

5.4 Your duty of care also applies to tags. You may not set or mark any tags that could be understood as racist, violent, sexist, discriminatory, hurtful, offensive or objectionable.
6. Our disclaimer
6.1 swoice has no influence on the decision of users as to which tags they set and mark for which content on the network. The setting and tagging of tags is the sole responsibility of the user. swoice excludes any liability for any damages that may arise from the use, processing and publication of tags and their tagging.
6.2 swoice disclaims any warranty and liability for all services provided to the fullest extent permitted by law. The provider of swoice, Swoice Internet Service GmbH, can under no circumstances be held liable for general Internet security risks, in particular for service failure, data theft, data manipulation, data loss, sabotage or human error.
6.3 In any case, Swoice Internet Service GmbH is only liable for damages caused by gross negligence or wilful intent (liability for care in one's own affairs); this also applies to the legally authorised representatives, employees and vicarious agents of swoice.
7. Our data protection
Free networking of content on the Internet is only possible if the protection of your personal data is secure from the outset and throughout the entire processing chain. That is why secure and anonymised handling of data is swoice's guiding principle when it comes to data protection. 8.1 swoice is constantly developing and optimising the services and functions offered. The offer can be supplemented, changed, interrupted or deleted without prior notice. 8.2 swoice will inform you if there are any significant changes to the terms of use and data protection provisions. If you continue to use swoice afterwards, this means that you agree to the updated terms of use. If these terms of use are translated into another language and there is a discrepancy between the German text and the translated text, the German text shall prevail. The terms of use and the use of swoice are governed exclusively by the law of the Federal Republic of Germany. The place of jurisdiction is Düsseldorf.
